Algemene Voorwaarden – Fotostudio New Brooklyn

Artikel 1 – Definities
In deze algemene voorwaarden wordt verstaan onder:

  • Fotostudio New Brooklyn: gevestigd aan Europalaan 511, 1362 JV Almere, KvK 76277321, die de fotografie- en videografiediensten aanbiedt.

  • Klant: de natuurlijke persoon of rechtspersoon die de opdracht verstrekt.

  • Opdracht: de overeenkomst tussen de klant en Fotostudio New Brooklyn voor het leveren van diensten.

  • Materialen: foto’s, video’s en andere digitale of fysieke producten die voortkomen uit de opdracht.

Artikel 2 – Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op alle offertes, opdrachten en overeenkomsten tussen Fotostudio New Brooklyn en de klant, tenzij uitdrukkelijk anders is overeengekomen.
Door het aangaan van een overeenkomst met Fotostudio New Brooklyn verklaart de klant zich akkoord met deze algemene voorwaarden.

Artikel 3 – Offertes en Prijzen

  • Alle offertes van Fotostudio New Brooklyn zijn vrijblijvend en 14 dagen geldig, tenzij anders vermeld.

  • Prijzen zijn exclusief btw, tenzij anders vermeld.

  • Eventuele extra kosten zoals reiskosten, parkeerkosten of overnachtingen worden apart in rekening gebracht, tenzij anders overeengekomen.

Artikel 4 – Betaling

  • De klant dient uiterlijk 2 dagen voorafgaand aan de levering van de fotoshoot te betalen, tenzij schriftelijk anders is overeengekomen.

  • Bij niet tijdige betaling behoudt Fotostudio New Brooklyn zich het recht voor om de levering van de producten en diensten op te schorten totdat volledige betaling is ontvangen.

Artikel 5 – Annulering

  • Pasfoto’s: Na boeking kunnen pasfoto-afspraken niet worden geannuleerd.

  • Indien de klant een pasfoto-afspraak niet nakomt op het geboekte tijdstip, kan in overleg een nieuwe afspraak worden ingepland, afhankelijk van de beschikbaarheid van de studio en de fotografen.

  • Fotoshoots:

    • Annulering tot 2 weken voor de geplande fotoshoot: 20% van de getekende offerte is verschuldigd.

    • Annulering binnen 48 uur voor de geplande fotoshoot: 50% van de getekende offerte is verschuldigd.

Artikel 6 – Uitvoering van de Opdracht

  • Fotostudio New Brooklyn zal de opdracht naar beste inzicht en vermogen uitvoeren.

  • De klant is verantwoordelijk voor het verschaffen van correcte en tijdige informatie die nodig is voor de uitvoering van de opdracht.

  • Bij fotoshoots op locatie is de klant verantwoordelijk voor het verkrijgen van de nodige vergunningen of toestemmingen.

Artikel 7 – Levering en Oplevering

  • De materialen worden binnen een afgesproken termijn na de shoot geleverd, afhankelijk van de aard van de opdracht.

  • Levering van digitale materialen gebeurt via een beveiligde online omgeving of op een fysieke drager zoals een USB-stick, afhankelijk van wat is overeengekomen.

  • Klachten over de geleverde materialen dienen binnen 7 dagen na levering schriftelijk te worden gemeld.

Artikel 8 – Auteursrecht en Gebruik

  • Het auteursrecht van de geleverde foto’s en video’s berust bij Fotostudio New Brooklyn, tenzij schriftelijk anders is overeengekomen.

  • De klant verkrijgt na volledige betaling het recht om de materialen voor eigen gebruik aan te wenden. Commercieel gebruik is enkel toegestaan met voorafgaande schriftelijke toestemming van Fotostudio New Brooklyn.

  • Fotostudio New Brooklyn behoudt het recht om de materialen te gebruiken voor eigen promotiedoeleinden, tenzij de klant vooraf schriftelijk bezwaar heeft gemaakt.

Artikel 9 – Aansprakelijkheid

  • Fotostudio New Brooklyn is niet aansprakelijk voor schade ontstaan tijdens de uitvoering van de opdracht, tenzij er sprake is van opzet of grove nalatigheid.

  • De aansprakelijkheid van Fotostudio New Brooklyn is in elk geval beperkt tot het bedrag dat door de klant is betaald voor de betreffende opdracht.

Artikel 10 – Geschillen

  • Op alle rechtsbetrekkingen waarbij Fotostudio New Brooklyn partij is, is uitsluitend het Nederlandse recht van toepassing.

  • Geschillen zullen worden voorgelegd aan de bevoegde rechter in het arrondissement waar Fotostudio New Brooklyn is gevestigd.

Artikel 11 – Overmacht

  • In geval van overmacht is Fotostudio New Brooklyn gerechtigd de overeenkomst te ontbinden of de uitvoering van de opdracht op te schorten, zonder dat de klant recht heeft op schadevergoeding.

Artikel 12 – Wijzigingen in Algemene Voorwaarden

  • Fotostudio New Brooklyn behoudt zich het recht voor deze algemene voorwaarden te wijzigen of aan te vullen.

  • Wijzigingen worden schriftelijk aan de klant medegedeeld en treden in werking 30 dagen na deze mededeling.

Terms and Conditions – Fotostudio New Brooklyn

Article 1 – Definitions
In these general terms and conditions, the following definitions apply:

  • Fotostudio New Brooklyn: located at Europalaan 511, 1362 JV Almere, KvK 76277321, providing photography and videography services.

  • Client: the individual or legal entity that commissions the assignment.

  • Assignment: the agreement between the client and Fotostudio New Brooklyn for the provision of services.

  • Materials: photos, videos, and other digital or physical products resulting from the assignment.

Article 2 – Applicability
These terms and conditions apply to all quotations, assignments, and agreements between Fotostudio New Brooklyn and the client, unless explicitly agreed otherwise.
By entering into an agreement with Fotostudio New Brooklyn, the client agrees to these terms and conditions.

 

Article 3 – Quotations and Prices

  • All quotations from Fotostudio New Brooklyn are without obligation and valid for 14 days, unless otherwise stated.

  • Prices are exclusive of VAT unless otherwise specified.

  • Any additional costs such as travel expenses, parking fees, or accommodation costs will be charged separately unless agreed otherwise.

Article 4 – Payment

  • The client must make payment at least 2 days before the scheduled photoshoot, unless otherwise agreed in writing.

  • In the event of late payment, Fotostudio New Brooklyn reserves the right to suspend the provision of products and services until full payment has been received.

Article 5 – Cancellation

  • Passport photos: Once booked, passport photo appointments cannot be canceled.

  • If the client does not attend the booked passport photo appointment, a new appointment can be scheduled in consultation, subject to the availability of the studio and photographers.

  • Photoshoots:

    • Cancellation up to 2 weeks before the scheduled photoshoot: 20% of the signed quotation is payable.

    • Cancellation within 48 hours before the scheduled photoshoot: 50% of the signed quotation is payable.

Article 6 – Execution of the Assignment

  • Fotostudio New Brooklyn will carry out the assignment to the best of its knowledge and ability.

  • The client is responsible for providing accurate and timely information required for the execution of the assignment.

  • For photoshoots on location, the client is responsible for obtaining the necessary permits or permissions.

Article 7 – Delivery and Completion

  • The materials will be delivered within an agreed timeframe after the shoot, depending on the nature of the assignment.

  • Digital materials will be delivered via a secure online environment or on a physical medium such as a USB stick, depending on the agreement.

  • Complaints regarding the delivered materials must be submitted in writing within 7 days of delivery.

Article 8 – Copyright and Usage

  • The copyright of the delivered photos and videos remains with Fotostudio New Brooklyn, unless otherwise agreed in writing.

  • Upon full payment, the client acquires the right to use the materials for personal purposes. Commercial use is only permitted with prior written consent from Fotostudio New Brooklyn.

  • Fotostudio New Brooklyn reserves the right to use the materials for its own promotional purposes unless the client has objected in writing in advance.

Article 9 – Liability

  • Fotostudio New Brooklyn is not liable for damages arising during the execution of the assignment, unless there is intent or gross negligence.

  • The liability of Fotostudio New Brooklyn is in any case limited to the amount paid by the client for the respective assignment.

Article 10 – Disputes

  • All legal relationships in which Fotostudio New Brooklyn is a party are governed exclusively by Dutch law.

  • Disputes will be submitted to the competent court in the district where Fotostudio New Brooklyn is located.

Article 11 – Force Majeure

  • In the event of force majeure, Fotostudio New Brooklyn is entitled to dissolve the agreement or suspend the execution of the assignment, without the client being entitled to compensation.

Article 12 – Amendments to the General Terms and Conditions

  • Fotostudio New Brooklyn reserves the right to amend or supplement these general terms and conditions.

  • Changes will be communicated to the client in writing and will take effect 30 days after this notification.
